Settlement Reached in Literary Works in Electronic Databases Copyright Litigation

A Settlement has been reached in a class action lawsuit alleging that commercial electronic databases and certain print publishers infringed the copyrights of freelance authors. The lawsuit alleges that the print publishers first published the works with the authors' permission and then sold them to the electronic databases which reproduced, displayed, sold and/or distributed the authors' works without the authors' permission.
The Settlement applies to English language literary works that were reproduced on a commercial electronic database without the authors' permission. Writers may be eligible to participate in the Settlement even if the works were not registered with the U.S. Copyright Office, and even if they were originally published outside the U.S. This Settlement also covers English language works in Canadian publications and Canadian editions of non-Canadian publications. Excluded are works-for-hire and works for which the author granted electronic rights to the original publisher.
Authors have the right to participate in, comment on, object to, or opt-out of the Settlement per the terms of the Settlement Agreement. There will be a final fairness hearing on the proposed settlement on July 28 at 10:00 a.m. before the Honorable George B. Daniels, U.S. District Court, Courtroom 618, 40 Centre Street, New York, NY 10007.
